Attorney General’s office begins legal procedures against ICC-wanted al-Najeem in Libya

On 9 July, the Attorney General’s Office said that following the lifting of the procedural restriction on the case of Osama Al-Masri al-Najeem, it had initiated a public lawsuit against him in accordance with the rules of national jurisdiction. It began its preliminary procedures by examining the elements of the crimes included in the arrest warrant issued by Pre-Trial Chamber I of the International Criminal Court (ICC). Al-Najeem attended an investigation session on 28 April 2025.

On 13 July, the Government of National Unity’s (GNU) Ministry of Justice (MoJ) issued a statement in which it confirmed lifting the procedural restrictions on al-Najeem based on a request by the AG. It also disclosed its decision not to hand him over to the ICC for several reasons, the most important of which is the latter’s failure to provide any evidence proving his involvement in committing crimes against humanity. However, the MoJ later deleted this statement.
